This privacy policy applies to the Jockeys’ Guild, Inc. ("the Guild") website located at www.jockeysguild.com and its affiliated websites, mobile applications, and digital services (collectively, the "Services"). This policy describes how we collect, use, share, and protect your information, including your rights and choices regarding your personal data.


The Website(s) is operated by Jockeys’ Guild, Inc. By using the Website(s), you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree, please do not use our Website(s). This Privacy Statement applies only to information collected online through the Website and does not describe the ways in which we may collect or use information obtained offline or through any means other than our Website.


Additionally, all personal information collected for accounts and membership purposes will be stored on a cloud-based service through Neon One.

For purposes of this Privacy Policy, “Personal Information” refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you, and includes “personal data” or similar terms as defined in applicable law such as your full name, street address or email address. When other information is associated with personal information, it also becomes personally identifiable information for the purposes of this privacy policy.

While the internet is a necessary tool which is extremely beneficial in our daily lives, using it comes with risks, including sharing your personal information. For example, your real name (lots of people on the Internet use aliases, alter egos or nicknames), street address, phone number, or e-mail address. When you go online, the websites you visit may be gathering information about you without your knowledge. At the Guild, we strive to help our Members and Supporters protect their privacy while enjoying our services.


We collect information from our Members or Supporters during the registration process and, occasionally, at other times. All information, including demographics and other necessary information for our members will be securely stored on cloud-based server through Neon One.

The Jockeys’ Guild and related organizations, including the Jockeys’ Guild Education Foundation (JGEF), take your right to privacy and the protection of your personal data seriously. For decades, we have successfully protected data related to the records of all of our members and their families.


In compliance with the General Data Protection Regulation (GDPR), effective May 25, 2018, the Guild has established the Privacy Policy to help Our Members and others who use our Website(s) to help understand what information we collect, why we collect it, and how you can update, manage and control your information.


Types of Information that may be Collected

The Jockeys’ Guild is committed to protecting and serving as a representative of the professional Thoroughbred and Quarter Horse jockeys in the America, and that includes providing the opportunity for the public to engage with the jockeys in various ways. As such, the personal information we collect differs depending on the way in which you are engaging with the Guild. To keep things simple, the Guild’s audience will be classified as two separate groups: Guild Members and Guild Supporters.


As a Guild Member, we collect contact information such as name, address, telephone number, email, unique identifiers, such as your user ID or user password, demographic information, such as your date of birth, age, gender, education, racetracks where you typically ride, length of time licensed as jockey, states where you are licensed as a jockey, marital status, number of children, emergency contact information, designated beneficiaries, or similar information. In the near future, you will also be able to choose to add additional personal information to your member account at jockeysguild.com, including payment information.  Please see the privacy policy of Neon One


Whether you are a Guild Member or a Guild Supporter, you can create an online account at www.jockeysguild.com. When you create an account, you provide us with personal information that includes your name and a password. Through our new website, Jockeys’ Guild will collect information to provide better services to all our users.


Information You Provide Us: In the course of using the Website(s), we may ask you to provide us with certain information, such as name, mailing address, email address, phone number, unique identifiers, such as your user ID or user password, demographic information, such as your date of birth, age, gender, education, racetracks where you typically ride, length of time licensed as jockey, states where you are licensed as a jockey, marital status, number of children, emergency contact information, designated beneficiaries, or similar information.


When you are signed into Member services, we also collect information that we store with your Member account, which we treat as personal information.

Even if you don’t have a Member account, you might choose to provide us with information — such as an email address to receive updates and information from the Guild. When you subscribe to our email newsletter, we collect information related to your IP address, device, browser, screen size and any links you click.


In some cases, the Guild contracts with third party service providers, including Neon One and Neon Pay, to help make business practices more efficient. These third-party service providers may collect your personal information on the Guild’s behalf. Third party service providers enter into contracts with the Guild and these contracts include confidentiality requirements and the measures the third-party service provider takes to ensure that your data is protected.


Site Usage Information: We may receive and store certain types of internet usage information whenever you visit the Website(s), such as your IP address.


HOW INFORMATION MAY BE COLLECTED

We may collect information from you in several different areas on the Website(s), including but not limited to those described below:


Registration: You may be asked to complete a registration form and provide personally identifiable information; you may also be asked to choose a user ID and password in order to take advantage of certain features the Website(s) may choose to offer, such as newsletters or contests. Participation in registration is voluntary and you will have the opportunity to decide whether or not to disclose information to the Website(s).


Newsletters and Website Emails: We offer free newsletters to share information with you about the Website(s), about us and our partners and subsidiaries, or about our benefits partners. You may receive a newsletter either by opting-in or registering for the Guild newsletter or in conjunction with a special feature or membership for which you have registered for on the Website(s) or in conjunction with Guild membership. Participation is voluntary and you will have the opportunity to decide whether or not to disclose information to the Website(s). You may also cancel your free email subscription by following the instructions provided on the Website(s) or in the newsletters or email.


Surveys or voting: From time-to-time we may request personally identifiable information from you in conjunction with a survey or voting poll. Participation is voluntary and you will have the opportunity to decide whether or not to disclose information to the Website(s).


If you do not wish to participate, simply click the "No, Thank You" link and you will not see this window again. If you choose to participate, you'll be prompted to answer a series of online questions. Your responses are confidential and will be used for statistical analysis, product development purposes or membership service enhancements only; no information on an individual's preferences will be shared with any outside organization. You will be prompted to enter your e-mail address for validation purposes but no other personal information (name, address, etc.) will be collected as part of the surveys.


Cookies: As with many Websites, our Website(s) uses a technology called "cookies." A cookie is a unique, random number that is stored in the browser on your computer. The cookie doesn't actually identify you, just the computer that is used to visit the site. Cookies automatically identify your browser to the Website(s) whenever your computer is used to visit the Website(s). Transaction Information: If you conduct a financial transaction with our Website(s) through services offered on our Website(s), including joining and paying annual dues, we may ask you to input certain information including contact information, demographic information and financial information. We may use this information to complete the transaction that you have requested. For your protection, such information is collected and stored through encrypted means through NEON One Pay.


Email Communications: When you open emails from us, we may receive confirmation noting you opened the email, if your computer supports such capabilities. We also may keep track of what emails we send you and what emails you may be receiving from our subsidiaries and affiliates. Additionally, we keep a record of what communications you have opted to receive or not to receive. Subscribers may manage their email preferences on by logging into their Jockeys' Guild accounts, or by emailing communications@jockeysguild.com.


Cellular Communications: Where you have given have given us permission, we will use your cellular phone number to communicate with you periodically by text message or by telephone, including by autodialers, about the Guild’s activities, information, updates and offerings. We may also use your cellular phone number for administrative purposes, such as notifying you of major Website changes, sending messages related to actions you have taken on the site or for member or organizational purposes, such as for notifications about major Guild events (including, but not limited to, annual meetings, colony meetings and conferences) that you may wish to or are participating in. By providing us with your cellular phone number, you understand and agree that while the Guild will never charge you for text message alerts or telephone calls, your cellular phone service provider may charge you for receipt of such text messages and telephone calls and that you, and not the Guild, are responsible for any such charges. Although we hope you’ll find these communications informative and useful, if you don’t, you can always text STOP to unsubscribe at any time, and you may text HELP if you would like more information.




THE BUSINESS AND COMMERCIAL PURPOSES FOR WHICH WE COLLECT AND USE YOUR PERSONAL INFORMATION

The Guild uses the information we collect from the various ways you engage with us for the following purposes:


  • To serve our Guild members by communicating effectively with them through a variety of methods, including postal mail, phone, email, facsimile and other types of correspondence.
  • To provide our Guild Members information about issues impacting the racing industry and in particular jockeys;
  • To distribute invitations and provide logistics for events where Guild Members participation is beneficial to the community
  • To customize the Guild Member experience through the use of third-party marketing tools.
  • To provide our Guild Members and Supporters with helpful information from the Guild, our leadership, industry partners and our publications.
  • To improve our services by learning about and communicating with our Guild Members and Supporters.
  • To enable the Guild to process, validate and verify memberships or subscriptions.
  • To monitor, protect, and maintain the security and integrity of our Sites and our business, such as protecting against and preventing fraud, unauthorized transactions, claims and other liabilities.
  • To comply with applicable laws and regulations and respond to lawful requests and communications from law enforcement and other government officials.
  • To protect our rights, privacy, safety, property and/or those of others.

 

The Guild does not release Guild Member or Supporter information to any outside organization except certain Guild partners who provide member services agree not to sell the list or make it available to any other organization. We do not sell our membership or subscriber lists to any other organization.


In addition, we take extra measures to protect the data related to minor (ages 18 and under) Guild Members and Supporters. Unless otherwise disclosed during collection, the Guild does not provide any personally identifying information, regardless of its source, to any third party for any purpose whatsoever from our members or subscribers under 18 years of age.



WITH WHOM THE INFORMATION MAY BE SHARED

At times, we may share Guild Members personal information with others for the purpose of providing the member benefits. When this type of information is shared, the other parties do not have access to personally identifiable information. The following outlines the ways in which the Guild Member’s information may be shared with others and the ways in which he or she may opt-out of having his or her information shared:


  • Our Service Providers. We may disclose Guild Member’s Personal Information to our service providers that provide business, professional, analytics, or technical support services to us, help us operate our business and the Sites, or administer activities on our behalf. We require our service providers to only use our Guild Member’s Personal Information in connection with providing services to the Guild and its members.


  • Our Business Partners. We may disclose Guild Members’ Personal Information to other companies with whom we partner to provide services or other offerings to the Guild Members and carry out other related activities.


  • Our Research Partners. We may disclose Guild Member’s Personal Information to our research partners, including those that administer surveys or conduct research projects in partnership with us or on our behalf relating to safety and research matters.


  • Our Analytics Partners. We may disclose Guild Member’s Personal Information to our partners that assist us in performing analytics and help us measure the effectiveness of our Sites’ content and our efforts to serve the Guild Members and Supporters.


  • Competent Governmental, Regulatory, and Public Authorities. We may disclose Guild Members’ and Supporters’ Personal Information to government and law enforcement authorities, in each case to comply with legal or regulatory obligations or requests.


  • Other Third Parties. We will disclose Guild Members’ Personal Information to other third parties at your direction or with your consent. Additionally, we will disclose Guild Members’ and Supporters’ Personal Information as we believe necessary or appropriate to: (a) comply with applicable law; (b) enforce our terms and conditions; (c) protect our operations; (d) protect our rights, privacy, safety, or property, and/or those of Guild Member, Supporter, or others; and (e) allow us to pursue available remedies or limit damages that we may sustain.


We may disclose Guild Member’s Personal Information for other reasons that we will describe at the time of information collection or prior to disclosing his or her information.


Please note that we may de-identify or aggregate Personal Information so that it will no longer be considered Personal Information and disclose such information to other parties for purposes consistent with those described in this Privacy Policy.


How the Guild Maintains Security of Your Personal Information 

By using the Guild’s website, newsletters and/or services, you signify your assent to Jockeys’ Guild’s Privacy Policy. Your continued use of the Guild Website(s) following the posting of changes to these terms will mean you accept those changes.


While use of our services signifies your consent to the Jockeys’ Guild’s Privacy Policy, you have options regarding how to manage and control your personal data. Currently, you can update your personal information by contacting Jockeys’ Guild via phone, email, mail or other communication methods. Additionally, you are able to update your personal information by logging into your Guild Member or Supporter account at jockeysguild.com.


At any time, you can opt out of (unsubscribe from) email newsletters the Guild sends you regarding Guild, our industry partners, or our publications. However, if you are a Guild Member, you cannot opt out of communication required to conduct normal business with Jockeys’ Guild, including voting and surveys.


You have the right to have your personal information deleted by Guild upon request at any time. However, because of the historical importance of accurate membership records related the organization, your Guild Member information will not be removed from records. Additionally, the Guild must retain data related to benefits provided and received.


YOUR PRIVACY CHOICES AND RIGHTS

You have the ability to make certain choices about how we use your Personal Information, as follows:


A.     Unsubscribing from our Marketing and Promotional Communications

  • From time to time, we may send our members marketing and promotional communications, including special offers from us or our partners. If you no longer wish to receive promotional and marketing emails from us, you may opt out of such communications at any time by following the opt-out instructions included in any promotional or marketing email you receive from us.


B.     Privacy Rights and Requests.

Depending on your U.S. state of residence, you may have certain rights in relation to your Personal Information, including:

  • Depending on the US state in which you reside, you may have additional rights that may include the following:
  • The right to confirm whether we process your personal information and access your personal information. 
  • The right to correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing.
  • The right to delete personal information we have about you. 
  • The right to opt out of the processing of your personal information for purposes of targeted advertising, the sale of personal information, and/or profiling in furtherance of decisions that produce legal or similarly significant effects.
  • The right to obtain a copy of personal information we have obtained about you in a portable and, to the extent technically feasible, readily usable format.


Please note that, where permitted under applicable law, we may decline a request if we are unable to verify your identity (or an agent’s authority to make the request) and confirm the Personal Information we maintain relates to you. If your request is denied, you may have the right to appeal our decision.

C.     CALIFORNIA RESIDENTS

Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of the Guild who are California residents to request certain information regarding its disclosure of personal information to third parties for their direct marketing purposes.  Please click the link to review.

How You Can Control Cookies

You have the right to decide whether to accept or reject cookies.

If you choose to reject cookies, you may still use www.jockeysguild.com, though your access to some functionality and areas of www.jockeysguild.com may be restricted. INTERNAL CHAT ROOMS, FORUMS, AND MESSAGE BOARDS

The Website(s) may make internal chat rooms, forums and message boards available to its members. You are not required to provide any personal information when using these areas except in login-specific areas but may choose to do so. IF you post personal information online, it will be available to the membership portal, and you may receive unsolicited messages from other parties. We cannot ensure the security of any information you choose to make public in a chat room, forum, or message board. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy. Please exercise caution when deciding to disclose personal information in these areas.

LINKS TO OTHER WEBSITES

You should be aware that when you are on the Website(s) you could be directed to other websites. For example, if you "click" on an industry affiliate, the "click" may take you off the Website(s) onto a different website. This includes links from industry affiliates and marketing partners. The Guild’s policy does not extend to anything that is inherent in the operation of the Internet, and therefore beyond the Guild’s control and is not to be applied in any manner contrary to applicable law or governmental regulation.

LINKING TO JOCKEYS’ GUILD WEBSITE(S) 

The Guild encourages appropriate industry partners and organizations (hereinafter referred to as "Partner”) to place a link from their site on the Internet to Jockeysguild.com or another Guild website. By linking to an Jockeys’ Guild Website(s), Partner agrees that: (1) Partner has no rights in or to Jockeys’ Guild trademarks or service marks by virtue of such link; (2) Such link does not confer to Partner any rights to distribute, publish or otherwise use copyrighted material of Jockeys’ Guild; (3) Partner has no rights in or to the trademarks or service marks of any third party displayed on an Jockeys’ Guild Website; and (4) Partner will not use such link for any illegal, immoral, or improper purpose, nor will Partner have any material detrimental to the Jockeys’ Guild on its site. Partner further agrees that, upon e-mail or other notice from Jockeys’ Guild, Partner will immediately remove all links from its site to Jockeys’ Guild’s Website(s).


YOUR ACCEPTANCE OF THE PRIVACY POLICY AND NOTIFICATION OF CHANGES TO THE POLICY

By using our Website(s), you signify your agreement to the terms of the Guild's Privacy Policy. If you do not agree to this policy, please do not use our Website(s). If we make a material change to the way in which we collect, use, and/or share your personal information, we will post a notice on our Website(s) and/or send an email to users who have provided an email address. CORRECTING/UPDATING PERSONAL INFORMATION

If your personal information changes (such as your email address or zip code), or if you no longer desire to access our Website(s), we will endeavor to provide a way to correct, update or remove the personal information you have provided to us. SMS/TEXTING

Jockeys’ Guild, Inc. collects opt-in verbally during member enrollement enrollment or over the phone. When a member is registered for the first time, they are asked to provide the phone number, and staff is trained to ask if the customer would like to opt in to SMS-based notifications. They will be verbally informed that "Message and data rates may apply", "Message frequency may vary", and they can "text HELP for support or more information and STOP to unsubscribe at any time". They will also be informed that their phone number will not be shared with third parties for marketing or promotional purposes.

IMPORTANT FACTS

We do not release Guild Members or Supporters names or information to any outside organization except certain Guild Partners who agree not to sell the list or make it available to any other organization. We do not sell our Guild Member or Supporter lists to any other organization. We may send Members or Supporters e-mail notifications of new features, services and topic-based news alerts. Only those Guild Members or Supporters who sign up for these announcements will receive them. Guild Members or Supporters may edit registration information or cancel a Membership or Subscription at any time. We reserve the right to contact any Guild Member at any time regarding membership, matters pertaining to racing, events, or any other related issues or questions as well as any changes.


MINORS (Ages 18 & Under)

The Guild Website(s) is a general audience website. We do not currently collect any personal information from individuals under the age of fifteen on the Website(s), nor do we knowingly solicit or collect any Personal Information from children under the age of 18 years other than those individuals who are Guild Members with the consent and authorization of their parent or legal guardian.


No information should be submitted to or posted by Supporters or other guests under 18 years of age without the consent of their parent or guardian. Unless otherwise disclosed during collection, the Guild does not provide any personally identifying information, regardless of its source, to any third party for any purpose whatsoever from our Members, Supporters, or other guests under 18 years of age.


No information collected from Guild Members or Supporters under 18 years of age is used for any marketing or promotional purposes whatsoever, unless it is directed to the parents or guardians of that particular youth. Any exception to this will be explicitly stated during the Member’s enrollment and will be used only for the purpose specified.


We only allow Guild Members, Supporters, or Guests under 18 years of age to receive communications from the Guild when it directed to the parents or guardians. Additionally, only those youth under 18 whose parents or guardians sign specific consent forms will be allowed to be listed on the Guild’s website.



If you are a parent or legal guardian and think that your child has given us data, or you have you can contact us in writing or by email as provided below.  Please mark your inquiries “Children’s Privacy Information Request.” If we learn that a minor has provided Personal Information through our Sites, we will use reasonable efforts to remove such information from our files.

California Privacy policy

This California Privacy Notice is effective as of May 1, 2026.


This notice supplements the Jockeys Guild, Inc. “Privacy Policy” and applies only to residents of California (“California Consumer”). 

This Notice sets forth the disclosures and rights for California Consumers regarding their Personal Information, as required by the California Consumer Privacy Act of 2018 ("CCPA"), the California Privacy Rights Act of 2020 ("CPRA"), and any implementing regulations adopted thereunder. Terms (including defined capitalized terms) used in this California Personnel Privacy Notice have the same meanings given in the CCPA and CPRA and the associated regulations, unless otherwise defined.   


EXERCISING YOUR CALIFORNIA RIGHTS

 California Consumers have the right to request: 


1. that we disclose to you what Personal Information we collect, use, disclose, and sell, including the right to request that we provide to you the categories and specific pieces of Personal Information we have collected about you ("Right to Know");

In order to have us provide specific pieces of information, we may require a signed declaration under penalty of perjury that you are the California Consumer whose Personal Information is the subject of the request. We will not provide you specific pieces of information that include the Personal Information of other persons, nor will we disclose certain pieces of information that the law requires us not to or that we determine is a high security risk, including your social security number, driver’s license number, financial account number, health insurance or medical information number, account passwords, security questions and answers, or unique biometric data, as applicable.


2. that we delete the Personal Information we collect from you ("Right to Delete"); 

Please note that as part of the verification process, once you submit a request to delete, we may follow up and require you to confirm that you want your information deleted.


3. that we correct inaccurate Personal Information we hold about you (“Right to Correct”);


4. to opt-out from the sharing of your Personal Information and Sensitive Personal Information to a third party for cross-context behavioral advertising (i.e., targeted advertising) (“Right to Opt-Out of Sharing”); “Shared” means the disclosure of Personal Information or Sensitive Personal Information to a third party for cross-context behavioral advertising. PGA of America does not “share” Personal Information for cross-context behavioral advertising. 


5. to opt-out from the sale of your Personal Information (“Right to Opt-Out of Sale”); Our use of analytics may be considered a sale of Personal Information. To opt-out of analytics, please visit our cookie banner and adjust your preferences; 


6. to limit the use and disclosure of Sensitive Personal Information; 

As disclosed in the chart below, we may collect certain information that is considered Sensitive Personal Information under California law. Under the CPRA Regulations, a business must only provide the Right to Limit the Use and Disclosure of Sensitive Personal Information when such use does not fall within the list of exceptions outlined in CPRA § 7027, subsection (m). Our use and disclosure of Sensitive Personal Information falls within this list of exceptions and we therefore do not offer such opt-out right at this time. We do not sell, or share for cross-context behavioral advertising, Personal Information or Sensitive Personal Information. For a description on how social media services and other third-party platforms, plug-ins, integrations or applications handle your information, please refer to their respective privacy policies and terms of use, which may permit you to modify your privacy settings. Verifying Your Requests

When you exercise your Right to Know, Right to Delete, and/or Right to Correct, we will take reasonable steps to verify your identity based upon the information you provide and the type of request you are making. We may require you to log into your internal personnel account or provide your unique personnel ID. We may also need to ask you to provide us with additional information to verify your identity and fulfill your request. We will only use any such information to verify your identity. If we cannot verify your identity, we will not be able to process the request.

Pursuant to the CPRA, we will not require you to verify your identity, beyond asking for the information necessary to complete your request, when you exercise your Right to Opt-Out of Sharing, Right to Opt-Out of Sale, or Right to Limit the Use and Disclosure of Sensitive Personal Information.

You may elect to use an agent to submit a request on your behalf. If you choose to do so, your agent must follow the instructions below to make the request. You may also make a request on behalf of your minor child. When your authorized agent submits a request on your behalf, we will request written permission signed by you and authorizing your agent to make the request on your behalf. The written permission must state your full legal name as the subject of the request, the full legal name of the individual who is acting as your agent and must be clear about the scope of permission granted. Alternatively, your agent may, but is not required to, submit a copy of a power of attorney under Probate Code sections 4000-4465. In either case, your agent should also indicate in their email the nature of the request. Your identity, in addition to your agent’s identity and authorization, will need to be independently verified in order for us to be able to fulfill the request. We may also ask you to directly confirm with us that you provided your agent permission to submit a request. Please keep in mind that if we do not receive adequate proof that your agent is authorized to act on your behalf, we will deny the request.
